Terms of Service

Version 2026-10-21 · in effect from 21 Oct 2026

1. Who we are and what these Terms cover

Yosei (“we”, “us”, “our”) provides an online certification-exam preparation service (the “Service”): question banks, practice sessions, full-length Mock Exams and performance analytics. These Terms are the agreement between you and us for your use of the Service. They apply from the moment you create an account.

Yosei is a service of Tutul B.V., a private limited company (besloten vennootschap) incorporated in the Netherlands, with its registered office at Achterweg 22, 2376 AX Nieuwe Wetering, the Netherlands, registered with the Netherlands Chamber of Commerce (Kamer van Koophandel) under number 12345678. “We”, “us” and “our” in these Terms mean Tutul B.V., and Tutul B.V. is the party you are contracting with.

You can reach us at soumitra@itutul.com. Which law governs this agreement, and which courts decide a dispute about it, is set out in section 14.

How we handle personal data is described separately in our Privacy Notice. Accepting these Terms is not consent to data processing, and we do not treat it as consent: it forms our contract with you.

2. Accepting these Terms

When you create an account you accept the version of these Terms shown to you at the time. We record which version you accepted and when. We keep that record for as long as you have an account, as evidence of the agreement between us. We do not record your IP address for this purpose.

Every version of these Terms remains available, so the text you accepted can always be produced. The version identifier appears at the top of this page.

3. Who may use the Service

You must be at least 16 years old to create an account. The Service is intended for individual learners preparing for a certification exam. Accounts are personal: one person, one account, and you may not share your account or your credentials with anyone else.

4. Your account

Your email address is your account identity. You must give an address you control and confirm it before you can use the Service; we will not activate an account on an unconfirmed address. You are responsible for keeping your password and any second-factor device secure, and for everything done through your account.

Giving your name is optional. If you supply one, you can change or remove it at any time in your profile.

Tell us promptly if you believe someone else has used your account. You can close your account at any time; see section 10.

5. What the Service is — and what it is not

The Service is study material. It helps you rehearse for an exam; it does not award, assess towards, or contribute to any qualification.

  • We are independent. We are not affiliated with, endorsed by, accredited by or authorised by any certification body, examination institute or training accreditor. Where we name a certification, we do so to describe what our material prepares you for. Trade marks and certification names belong to their respective owners.
  • Our questions are our own. They are written to resemble the style and syllabus coverage of the exam concerned. They are not real exam questions and are not drawn from any live question bank.
  • We do not promise you will pass. Scores, readiness indicators, analytics and predicted-performance figures in the Service are estimates based on your practice with our material. They are not a prediction of your result and are not a guarantee of any kind.
  • Syllabuses change. We keep material current on a best-effort basis, but the certification body’s own published syllabus always takes precedence over anything you read here.

6. Free access, trials and paid access

6.1 Free access and trials

Parts of the Service are free to use, with or without an account. Where we offer a trial of the paid material, it is limited to one trial per person, is time-limited, and may be limited in how much material it exposes. Attempting to obtain more than one trial — for example by creating additional accounts — is a breach of section 7.

6.2 What you are buying

Paid material is sold as an access pack for one exam. A pack gives you access to that exam’s paid question bank, practice sessions, mock exams and analytics, for your own preparation, for a fixed period starting when we confirm your payment.

  • One exam, not a family of exams. A pack covers the exam named at checkout and nothing else. Buying a Foundation-level exam does not give you the Practitioner-level one, and the other way round.
  • It is a one-off purchase, not a subscription. You pay once. There is nothing to cancel: no auto-renewal, no recurring charge, no standing payment mandate, no reminder that takes money. When the period ends, access ends, and we take nothing further unless you choose to buy again.
  • The price and the length of the period are fixed when you buy. Both are shown to you before you pay. If we later change what a pack costs or how long it lasts, that applies to new purchases only. It never shortens, lengthens or re-prices access you already hold.
  • Buying again extends, it does not stack. If you buy another pack for the same exam while your access is still running, we add the new period to the end of the one you have. You do not hold two overlapping packs and you never lose days you have already paid for.
  • Some prices are only available to returning buyers. Where we offer a cheaper renewal price, it is offered only to someone who holds, or recently held, access to that exam. Whether it is available to you is shown at checkout.

6.3 Prices and tax

Prices are in euro and include VAT. The price you see is the total you pay; we add nothing to it at checkout. We sell to consumers only. We do not issue business invoices, we cannot accept a business VAT identification number, and no purchase here is a reverse- charge supply. If you need to buy as a business, this is not the right service for you.

Before you pay we show you the exam, the pack, how long access lasts and the total price. The button that completes the purchase says in so many words that pressing it obliges you to pay.

6.4 Starting immediately, and your right of withdrawal

If you are a consumer in the European Union you normally have 14 days from the day the contract is made to withdraw from a distance purchase of digital content, without giving a reason and without penalty.

Digital content does not work like a parcel. Once we have opened the paid question bank to you, we cannot take back what you have already read. EU law therefore lets you ask us to start straight away, and treats that request as the end of the withdrawal right. We ask you to do exactly that, and we do not offer a delayed-start purchase.

At checkout you must tick a box, which you cannot skip, stating both of these things:

  • you expressly ask us to begin giving you access immediately, during the 14-day withdrawal period; and
  • you acknowledge that you will lose your right of withdrawal once we have done so.

We open access as soon as your payment is confirmed, which is normally within seconds. Your right of withdrawal ends at that moment. We repeat both statements back to you in the purchase confirmation we email you, so that you have a durable record of what you agreed and when.

Until we have opened access, the 14 days are still running and you may still withdraw — for example while a payment is being processed, or if a technical fault means the purchase was taken but access never opened. To withdraw, tell us in a clear statement at soumitra@itutul.com before the 14 days are up. You do not have to give a reason, and this wording is enough:

“I withdraw from my purchase of the [pack] access pack for [exam], made on [date]. [Your name, and the email address on your account.]”

We will refund everything you paid, using the same payment method you used, within 14 days of receiving your statement, and we will not charge you anything for withdrawing.

6.5 Refunds

Apart from the withdrawal right in section 6.4, and the statutory rights set out below, we do not give refunds. In particular:

  • We do not refund the unused part of a pack, in whole or in part. Not if you sit and pass your exam in the first week; not if you stop studying; not if you close your account; not if we close it because you broke section 7. A pack is access for a fixed period, priced as a single purchase on that basis, and it is not a balance that is drawn down.
  • We do not give refunds as a gesture of goodwill. We would rather say so plainly than let you assume otherwise. If you think something has gone wrong, write to us — but please read the next paragraph first, because it describes rights that do not depend on our goodwill at all.

That is our position, not the limit of your rights. Nothing above takes away the rights EU consumer law gives you, and two of them can still require us to give money back:

  • If the paid material is not as we described it, or does not work as it should. You are entitled to have it brought into conformity. If we cannot do that, or do not do it within a reasonable time and without significant inconvenience to you, or the same problem happens again, you are entitled to a proportionate reduction in the price, or to end the contract and be refunded for the part of the period affected. A serious failure does not have to be given a second chance first.
  • If we materially reduce access you have already paid for. Section 9 says what we will do, and where the law requires a remedy, you get one.

If you reverse a payment through your bank or card issuer, the access it paid for stops as soon as we are notified — immediately, not at the end of the period — because it is no longer paid for. This is not a penalty and we do not charge you a fee for it. If the dispute is later resolved in our favour, or you pay again, we restore the access and your saved work with it, as described in section 6.6. Asking us for a refund first is quicker and costs you nothing.

6.6 When access ends, and what happens to your work

When your access period ends, you stop being able to open the paid question bank, start new paid practice sessions, or review the questions and answer explanations in sessions you have already done. A session already under way when the period ends finishes normally.

Your statistics stay for a while. For a fixed window after expiry you keep the analytics view — your readiness score, accuracy trends, per-topic breakdown, weak areas and streak history. The length of that window is shown to you before you buy and is fixed at that point, in the same way as the price and the access period; today it is 120 days. Buying access to that exam again at any time during the window restores everything — your sessions, your statistics and your history — with a truthful gap for the days in between.

At the end of that window we delete it. All of your paid practice data for that exam — sessions, answers, statistics and history — is permanently deleted, and cannot be restored by us or by you afterwards. We email you before that happens. What remains is the record of the sale itself, which we keep because tax law requires it, as described in the Privacy Notice.

Free access is unaffected by all of this. You can keep using that exam’s free question bank whether or not you have ever paid.

7. Acceptable use

You agree not to:

  • copy, download in bulk, scrape, republish, resell, sublicense or otherwise distribute our questions, answers, rationales, scenarios or analytics, whether or not for profit;
  • use automated means — scripts, crawlers, headless browsers, harvesting tools — to access the Service, or attempt to enumerate our question bank;
  • share, sell or transfer your account, or let anyone else use it;
  • create multiple accounts to obtain additional free or trial access;
  • circumvent or attempt to circumvent access controls, rate limits, entitlement checks or any other technical restriction;
  • probe, scan or test the security of the Service except with our prior written permission, or interfere with its operation or with other users’ use of it;
  • use the Service unlawfully, or in a way that infringes anyone else’s rights.

8. Intellectual property

We (or our licensors) own the Service and everything in it, including question text, options, rationales, scenarios, syllabus structures, analytics and the software itself. Nothing in these Terms transfers any of it to you.

While your account is open we grant you a personal, non-exclusive, non-transferable, revocable licence to use the material you have access to, for your own exam preparation only. Anything you create in the Service — your answers, your flags, your notes, your study plan — remains yours; you grant us only the permission we need to store it and to show it back to you as part of the Service.

9. Availability and changes to the Service

We aim to keep the Service available, but we do not promise it will be uninterrupted or error-free. We may suspend it for maintenance, and we may add, change or withdraw features. Where a change would materially reduce access you have already paid for, we will tell you in advance and, where the law requires it, offer you a remedy.

10. Suspension, closing your account, and ending this agreement

You may close your account at any time from your account settings. Closing your account ends this agreement and deletes your personal data as described in the Privacy Notice, except where we are legally required to keep certain records.

We may suspend or close your account if you breach these Terms — in particular section 7 — or if we are required to do so by law. Where it is reasonable to do so we will tell you first and give you a chance to put things right. If we close your account for a breach, you are not entitled to a refund of any unused paid access, except where the law says otherwise (section 6.5).

11. Our responsibility to you

We provide the Service with reasonable care and skill. We are responsible for loss you suffer that is a foreseeable result of our breaking this agreement or failing to use reasonable care and skill, but we are not responsible for any loss that was not foreseeable, and we are not responsible for the outcome of any examination you sit.

Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be limited or excluded. If you are a consumer, you have statutory rights that these Terms do not affect, and nothing here requires you to give them up.

12. Changes to these Terms

These Terms are versioned. We may correct wording that does not change what either of us has agreed — a typo, a clearer sentence, a broken link — without a new version.

A material change is one that alters rights or obligations, pricing or payment, cancellation or refunds, acceptable use, intellectual property, liability, disputes, or suspension and termination. For a material change we publish a new version and ask you to accept it before you continue using the Service. If you would rather not accept it, you can close your account; you will still be able to reach these Terms, the Privacy Notice, your data export and account deletion.

13. Personal data

Our Privacy Notice explains what personal data we process, why, on what legal basis, who processes it on our behalf, how long we keep it and what rights you have. It is versioned independently of these Terms: updating it does not change anything you have agreed here, and does not require you to accept these Terms again.

14. General

If any part of these Terms turns out to be unenforceable, the rest continues to apply. Our not enforcing a term is not a waiver of it. You may not transfer your rights under these Terms to anyone else; we may transfer ours if the Service changes hands, and will tell you if we do.

These Terms, together with the Privacy Notice, are the whole agreement between us about your use of the Service.

These Terms, and any dispute about them or about your use of the Service, are governed by the law of the Netherlands, and the competent courts of the Netherlands may hear such a dispute. If you are a consumer living in the European Union, this does not take away the protection given to you by the mandatory consumer-law rules of the country you live in: you may also bring proceedings in the courts of that country, and we may bring proceedings against you only there.
